Unfortunately the user is responsible for what's happening in his/her server. Long ago I went through same problem with another free provider. I was not using the vps and the server was suspended by provider and didn't notice me about it. But it was my fault because it's better you shut down the vps if u don't use it for a while (unless you are running a web server). I thought I did but looked like I hadn't. It was my fault since what happens inside my vps is my responsibility, even if it's compromised and used by someone else.

well since everyone seems to be in agreement it is the user's fault & responsibility I will just terminate the vps and they will have to wait for next giveaway I assume then.
